These Terms and Conditions govern all services provided, arranged or facilitated by TropiGo Enterprise ("TropiGo", "we", "us" or "our"), including taxi and transportation services, island tours, vehicle rentals, retail products and business solutions.
By making a booking, submitting payment, renting a vehicle or using our services, customers acknowledge and agree to the applicable Terms and Conditions.
1. GENERAL BOOKINGS, PAYMENTS AND CANCELLATIONS
1.1 Bookings and Payments
All bookings are subject to availability and confirmation by TropiGo. Full payment or a deposit may be required to secure a reservation, with any outstanding balance payable by the agreed deadline.
TropiGo reserves the right to refuse or cancel bookings where payment requirements are not satisfied or where safety concerns, unlawful conduct or material breaches of these Terms arise.
1.2 Non-Refundable Payment Policy
ALL PAYMENTS, BOOKING DEPOSITS, ADVANCE PAYMENTS AND RESERVATION FEES ARE STRICTLY NON-REFUNDABLE FOR CUSTOMER-INITIATED CANCELLATIONS, EXCEPT WHERE REQUIRED BY LAW OR EXPRESSLY AGREED BY TROPIGO IN WRITING.
This includes cancellations, changes of mind, late arrivals, no-shows, missed services, early departures and unused portions of bookings.
Rescheduling may be permitted at TropiGo's sole discretion, subject to availability and applicable additional charges.
Refundable vehicle security deposits are governed separately by Section 3.
1.3 Service Changes and Cancellations
TropiGo reserves the right to modify, postpone or cancel services because of severe weather, unsafe conditions, mechanical difficulties, operational disruptions, government restrictions or other circumstances beyond its reasonable control.
Where practicable, alternative arrangements or rescheduling will be offered. Where a confirmed service cannot be provided, applicable statutory refund and consumer rights shall be respected.
Additional services, waiting time, route changes or extensions may attract extra charges communicated to the customer.
2. TAXI, TRANSPORTATION AND ISLAND TOUR SERVICES
2.1 Assumption of Risk and Exclusion of Liability
ALL CUSTOMERS PARTICIPATE IN TAXI SERVICES, SHUTTLES, ISLAND TOURS, EXCURSIONS AND RELATED ACTIVITIES AT THEIR OWN RISK, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Customers acknowledge that transportation and tourism activities involve inherent risks, including road traffic accidents, collisions, serious bodily injury, disability, death, slips, falls, drowning, adverse weather, environmental hazards and the actions of other persons.
TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF ANTIGUA AND BARBUDA, TROPIGO ENTERPRISE, ITS OWNER, EMPLOYEES, DRIVERS, REPRESENTATIVES AND AUTHORISED SERVICE PROVIDERS DISCLAIM ALL LIABILITY AND FINANCIAL RESPONSIBILITY FOR ACCIDENTS, INJURIES, DEATH, PROPERTY DAMAGE, LOSSES AND RELATED CLAIMS ARISING DURING OR IN CONNECTION WITH ITS TRANSPORTATION AND TOUR SERVICES.
This exclusion applies wherever legally permissible, including incidents arising from:
- Road traffic accidents, collisions and the actions of other motorists.
- Accidents or injuries occurring inside vehicles or while entering or exiting them.
- Injuries sustained at beaches, attractions, recreational facilities and tour destinations.
- Swimming, sightseeing, outdoor activities and other voluntary excursions.
- Customer negligence, misconduct or failure to follow safety instructions.
- Actions or omissions of independent third-party operators.
- Weather conditions, natural hazards and unforeseen events.
- Loss, theft or damage to personal belongings.
Customers voluntarily accept the inherent risks of their chosen activities and release TropiGo from claims arising from those risks or incidents for which TropiGo is not legally responsible.
Nothing in this provision excludes liability for death or personal injury caused by negligence for which TropiGo is legally responsible, or any liability that cannot lawfully be excluded.
2.2 Medical Expenses and Insurance
TROPIGO DOES NOT VOLUNTARILY ASSUME RESPONSIBILITY FOR MEDICAL EXPENSES, EMERGENCY TREATMENT, HOSPITALISATION, EVACUATION, REHABILITATION, LOST INCOME, MISSED TRAVEL CONNECTIONS OR OTHER FINANCIAL LOSSES ARISING FROM ACCIDENTS OR TOUR-RELATED INJURIES.
Customers are responsible for expenses for which TropiGo is not legally liable and are encouraged to obtain appropriate travel, accident and medical insurance.
Personal travel and medical insurance are not included in TropiGo's services unless expressly stated in writing.
Any emergency assistance provided by TropiGo shall not, by itself, constitute an admission of fault or acceptance of financial liability.
2.3 Customer Safety and Conduct
Customers must follow reasonable safety instructions, wear seat belts where required, supervise children in their care and refrain from behaviour that endangers themselves or others.
Customers are responsible for assessing their physical ability to participate in selected activities and should disclose relevant accessibility or health-related accommodation requirements before departure.
TropiGo may refuse or terminate participation where a customer's conduct presents a material safety risk, subject to applicable law.
2.4 Tour Itineraries, Delays and Third-Party Services
TropiGo may adjust routes, stops, itineraries or schedules because of weather, traffic, safety concerns, attraction availability or operational requirements.
Customers must allow adequate time for flights, cruises and other commitments. TropiGo shall not be responsible for delays or missed connections beyond its reasonable control where it is not legally liable.
Certain attractions and activities are operated independently. Customers participating in these activities may be subject to the third party's rules and conditions.
TropiGo does not assume liability for the acts or omissions of independent providers except where legally responsible.
3. VEHICLE RENTAL TERMS AND CONDITIONS
3.1 Rental Eligibility
All renters and authorised drivers must:
- Be at least 21 years old.
- Have a minimum of two (2) years of driving experience under a valid driving licence.
- Hold a valid licence appropriate for the vehicle.
- Obtain any temporary visitor's driving licence or permit required by Antigua and Barbuda law.
- Provide valid identification and any required supporting documentation.
- Be expressly authorised by TropiGo to operate the vehicle.
TropiGo may refuse vehicle handover where a customer does not meet applicable eligibility, licensing or insurance requirements.
3.2 Full Financial Responsibility for Damage and Third-Party Claims
THE RENTER ACCEPTS 100% FINANCIAL RESPONSIBILITY FOR ALL DAMAGE, LOSS, REPAIR EXPENSES AND THIRD-PARTY CLAIMS FOR WHICH THE RENTER IS LEGALLY OR CONTRACTUALLY LIABLE, REGARDLESS OF THE EXISTENCE OF INSURANCE COVERAGE.
This includes but is not limited to:
- Accidental or collision-related vehicle damage.
- Damage to bodywork, tyres, windows, interiors, mechanical components and accessories.
- Theft, loss of keys, towing, recovery and repair expenses.
- Reasonable loss-of-use charges while the vehicle is unavailable because of recoverable damage.
- Damage to other vehicles, buildings, public or private property.
- Third-party injury, loss or property damage arising from the renter's use of the vehicle.
THE RENTER'S LIABILITY IS NOT LIMITED TO THE AMOUNT OF THE SECURITY DEPOSIT.
Insurance coverage does not automatically relieve the renter of responsibility for deductibles, excesses, exclusions, uninsured losses or other lawfully recoverable charges. Any applicable insurance payment shall be credited against the corresponding loss, and no loss will be recovered twice.
Renters agree to indemnify TropiGo against reasonable third-party claims and losses arising from their negligent, unlawful or prohibited conduct, to the extent legally permissible.
Renters are not responsible for pre-existing damage, fair wear and tear, ordinary mechanical failure unrelated to misuse or losses for which they cannot lawfully be held responsible.
3.3 Security Deposits and Additional Charges
A security deposit may be required before vehicle collection and may be applied towards outstanding rental fees, recoverable damage, missing accessories, excess cleaning, fuel shortages, late returns and other legitimate charges.
Any balance exceeding the deposit remains payable by the renter. Unused refundable security deposits shall be returned in accordance with the rental agreement.
Rental payments are non-refundable for voluntary early returns or unused rental periods, except where otherwise required by law.
3.4 Vehicle Collection, Use and Return
Renters must inspect the vehicle before departure and report any existing damage. TropiGo may record the vehicle's condition using photographs, videos or inspection documents.
Vehicles must be returned at the agreed date, time and location, in substantially the same condition as collected, allowing for fair wear and tear.
Vehicles must not be driven by unauthorised persons, operated under the influence of alcohol or drugs, used for reckless or unlawful activities, sublet, or driven on unsuitable terrain where this creates an unreasonable risk of damage.
Commercial use or travel outside Antigua and Barbuda requires prior written authorisation.
Unauthorised extensions, late returns and prohibited vehicle use may result in termination of the rental agreement and additional lawfully recoverable charges.
3.5 Accidents, Damage and Mechanical Problems
In the event of an accident, theft, breakdown or damage, the renter must take reasonable safety precautions, notify the police where required, inform TropiGo promptly and cooperate with applicable reporting and insurance procedures.
No non-emergency repairs may be authorised without TropiGo's prior approval.
Renters must promptly report mechanical faults and stop using the vehicle where continued operation presents an unreasonable safety risk.
TropiGo remains responsible for providing vehicles that meet applicable roadworthiness and safety requirements.
4. RETAIL PRODUCTS AND CUSTOMISED MERCHANDISE
All products are subject to availability and confirmation of prices, quantities and specifications.
Customers ordering customised products, including shirts, stickers and promotional items, must approve relevant designs and specifications before production.
Payments for customised orders are non-refundable for customer-initiated cancellations once production has commenced, except where required by law.
5. BUSINESS SOLUTIONS
TropiGo provides business consultancy, project management, monitoring and evaluation, bookkeeping, data management, reporting, website development and creative services.
Specific services, deliverables, fees and timelines shall be agreed before work commences. Changes outside the agreed scope may attract additional charges.
Payments for completed work or services already performed are generally non-refundable, except where required by law or the applicable agreement.
While TropiGo will exercise reasonable care and skill, it does not guarantee business profits, grant approvals, funding, regulatory approval or specific commercial outcomes dependent on factors outside its control.
Customers remain responsible for their business decisions and statutory obligations.
6. CUSTOMER RESPONSIBILITIES AND GENERAL LIABILITY
Customers must provide accurate information, comply with applicable laws, respect personnel and property, fulfil payment obligations and follow reasonable safety instructions.
To the maximum extent permitted by law, customers shall be responsible for reasonably foreseeable losses and third-party claims arising from their negligence, unlawful behaviour, deliberate damage or material contractual breaches.
TropiGo shall not be responsible for losses caused by circumstances beyond its reasonable control, including natural disasters, severe weather, road closures, civil disturbances, government restrictions and major operational disruptions.
Any exclusion or limitation of liability contained in these Terms applies only to the extent permitted by law. Nothing excludes liability for death or personal injury resulting from negligence, fraud, compulsory insurance obligations or other liabilities that cannot legally be excluded.
7. WEBSITE CONTENT AND PERSONAL INFORMATION
All original TropiGo branding, photographs, graphics, written materials and website content remain the intellectual property of TropiGo or their respective owners and may not be reproduced or commercially used without permission.
TropiGo may collect personal information necessary to process bookings, verify rental eligibility, complete transactions and communicate with customers.
Personal information will be handled in accordance with applicable laws and TropiGo's Privacy Policy.
8. GOVERNING LAW, DISPUTES AND AMENDMENTS
These Terms and Conditions are governed by the laws of Antigua and Barbuda.
Customers should contact TropiGo promptly regarding complaints or disputed charges. Where a matter cannot be resolved amicably, the parties retain their rights to pursue lawful remedies before the competent authorities or courts.
TropiGo may update these Terms and Conditions at any time. Updated terms will be published on its website, while confirmed bookings shall generally remain subject to the terms applicable when the booking was accepted.
If any provision is found to be invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.
9. ACCEPTANCE AND CONTACT INFORMATION
By confirming a booking, making a payment, renting a vehicle or engaging TropiGo's services, customers acknowledge that they have been given an opportunity to review and accept these Terms and Conditions.
Customers using transportation and tour services specifically acknowledge the inherent risks of accidents, injury and other incidents, and accept the applicable limitations of liability to the fullest extent permitted by law.
Additional rental agreements or activity-specific acknowledgements may be required.
